NOW in NAPOLI is an online platform for travelers seeking to engage with locals in Napoli to offer them the most outstanding eat experiences, tours and activities. We are a marketplace where demand (travelers) meets supply (host/local/partner companies).

Through our website, travelers can book experiences, tours and activities with local hosts and partner companies.

From the point when the booking is made, NOW in NAPOLI acts solely as an intermediary between the traveler and the local or partner company. NOW in NAPOLI is not a party to any agreement between the traveler and the host/local/partner company and is not liable for any (attributable) failure to perform or other damages arising out of this relationship.

NOW in NAPOLI services to locals and partner companies
NOW in NAPOLI is an online platform for travelers seeking to engage with locals in Napoli to offer them the most outstanding eat experiences, tours and activities. We are a marketplace where demand (travelers) meets supply (local hosts/partner companies).

NOW in NAPOLI offers local hosts, guides and companies the possibility to offer tours and activities to travelers via the platform (website) as well as through partnerships with other companies.

Legal entity
NOW in NAPOLI is part of the company Ontdek Napels registered in the Netherlands. It is registered with the Chamber of Commerce in Woerden under number 75652390.

Applicability of T&C’s

Terms and Definitions
In the present Terms & Conditions, these terms are used and defined as follows:

Hosts/locals/partner companies:
Hosts/locals/partner companies are the suppliers of NOW in NAPOLI offerings. NOW in NAPOLI hosts/locals/partner companies are defined as such when their activities appear online on the platform and they can receive bookings via NOW in NAPOLI.

Travelers:
Travelers are the customers of NOW in NAPOLI, using the platform to make a reservation for an activity with a host/local/partner company.

Applicability of the Terms & Conditions
Any use of our website and/or services, as a website visitor, a traveler or a host/local/partner company, constitutes an agreement to all terms and conditions and warrants that users understand, agree to and accept all terms and conditions contained here.

Privacy policy
We respect your privacy and are committed to protect the information you share with us. We believe that you have a right to know our practices regarding the information we collect when you visit our website or use our services. Ask us.

Bookings (for travelers)
All bookings made via NOW in NAPOLI are manually transferred to the host/local/partner company requested.

Confirmation means that the reservation will be manually confirmed at the time and date chosen and with the requested host/local/partner company. This does not prevent NOW in NAPOLI from requesting a change of host/local/partner company, time or date.

A booking is only valid when confirmed by NOW in NAPOLI via email.

Bookings (for host/local/partner company)
All bookings made by travelers via NOW in NAPOLI engage the hosts/locals/partner companies to provide the service booked.

Payments
Full payment in advance:
When making a booking, it is possible you have to pay the full amount in advance. In this case you pay us the full amount stated on the website which is paid to the host/local/partner company, within 24 hours after the event has taken place in a satisfactory manner, while deducting the NOW in NAPOLI fee payable by the host/local/partner company. As a traveler no additional payments are needed; when the booking is confirmed by us, all payments are done.

Partial payment in advance:
In some cases, you will be asked to pay a share of the full amount upfront, as stated on our website. In this case, the remaining unpaid share has to be paid by the traveler to the host directly after the reserved event has taken place in a satisfactory manner.

Any payment facilitated by us for and on behalf of you, and transferred to the host will in each case constitute a payment of (part of) the booking price by you of the relevant product or service in final settlement of such (partial) due and payable price.

Payments in cash:
Most of our activities and services will require cash payment on the spot by the traveler to the host/local/partner company. In these cases the host/local/partner company transfers the agreed fee to NOW in NAPOLI.

Cancellation policy for travelers
Canceling confirmed booking: if the booking is canceled by the host/local/partner company you receive 100% refund.

If you choose to cancel the booking as a traveler:
– More than 48 hours before the experience date: You will be refunded 100% of the total price.
Less than 48 hours before the experience date: The host/local/partner company will be fully paid, you won’t receive a refund. If the payment needed to be in cash you will be charged with the full amount.

Exceptions are bookings that have products in the travelers name, such as football tickets. These are non-refundable after they’ve been purchased for the traveler.

Cancellation policy for host/locals or partner companies
Canceling confirmed bookings: if you as a host/local or partner cancel a booking, the traveler receives 100% refund.

Proprietary Material
NOW in NAPOLI content may not be used or copied without explicit authorization from NOW in NAPOLI.

All text, graphics, editorial content, data, formatting, graphs, designs, HTML, look and feel, photographs, music, sounds, images, software, videos, designs, typefaces and other content (collectively “Proprietary Material”) on this website is owned by NOW in NAPOLI, or is used with the owner’s permission. This Proprietary Material is protected in all forms, media and technologies. Users may not copy, download, use, redesign, reconfigure, or retransmit anything from this website without NOW in NAPOLI’ prior written permission.

Quality of information
While we do our utmost best to verify the quality of the events hosted by our hosts/local and partner companies, we cannot guarantee these are flawless and neither can we guarantee that all content on our website is without errors.

In the event of misleading representation or misconduct on our website or in the framework of the events held by hosts through our website and/or services, we may decide, in our sole discretion, to credit the traveler with a refund for the reservation amount paid or part thereof and charge the host with this amount. No action of us may be construed as accepting any liability other than as mentioned herein.

When rendering our service, the information we disclose is based on the information provided to us by the host/local/partner company. Although we will use reasonable skill and care in performing our service and verify (most of) the hosts we cannot guarantee that all information is accurate, complete and/or correct. Each host remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information displayed on our platform.
Therefore, use your own best judgment when using any of the services provided by our hosts.

Notwithstanding the foregoing, we, including without limitation any content, data and any information related hereto, is provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties of any kind, express or implied, including but not limited to warranties of title or non-infringement or implied warranties of use, merchantability or fitness for a particular purpose or use.

Warranties
NOW in NAPLI does not warrant that this website and/or our services will be uninterrupted or error-free. It may correct, modify, amend, enhance, improve and make any other changes to the website and services at any time or discontinue displaying or providing any content or features without a notice to any user.

Disclaimer
We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our users , including by hosts/locals/partner companies or travelers.

Liability
NOW in NAPOLI’s responsibility is limited to facilitating the availability of our website, application and services. The participation in any of the events hosted by the host/local/partner company is at your own risk.

NOW in NAPOLI’s liability for damages shall be limited to the amount paid by travelers. Except as provided herein, in no event shall NOW in NAPOLI be liable for any indirect, special, incidental or consequential damages of any kind, whether in an action of negligence or other tortious actions resulting from or arising out of participation in any of the events hosted by the host/local/partner company.

Issues and Complaints
We’ll assist you in case of issues or complaints where possible.
In case of a complaint about, or issue with the platform, services, please contact NOW in NAPOLI at contact@nowinnapoli.com to resolve the problem. In case of a complaint about an event you agree to contact NOW in NAPOLI within 1 day after the complaint has arisen and you agree to cooperate with and assist NOW in NAPOLI in good faith and you agree to provide NOW in NAPOLI with such information and take such actions as may be reasonably requested by NOW in NAPOLI. As a host you agree that in case of a no show or dissatisfactory deviations in the event caused by you, the traveler will be refunded and you won’t receive payment. As a traveler you understand that in case of a no show or no completion of/interruptions during the event caused by you, you as a traveler are responsible for any damages up to the amount paid.

In case of any damage claims or other complaints related to the event exceeding the amount paid, NOW in NAPOLI will mediate in finding a reasonable solution between traveler and host.

Any claim or complaint against NOW in NAPOLI, in respect of the service must be promptly submitted, but in any event within 14 days after the reserved event has taken place. Any claim or complaint that is submitted after the 14 days period, may be rejected and the claimant shall forfeit his/her right to any (damage or cost) compensation.

To the extent permitted by law, these T&C’s and the provision of our services shall be governed by and construed in accordance with Dutch law.
